Importance of the constitutional guarantees of the Ecuadorian legal system on protection and promotion of rights

Abstract

The constitutional guarantees within the Ecuadorian legal system have constituted an advance in the progression of rights, the recognition not only of rights but also of mechanisms that allow the application of justice in an adequate manner, with the purpose of guaranteeing the full enjoyment of rights. Within this article, the main theoretical, documentary, and bibliographic foundations have been addressed, which have allowed identifying those constitutional guarantees have a main relevance in the legal system in the international and national spheres. An analytical methodology has been applied with a qualitative approach, which has led to the conclusion that currently in Ecuador has been structured in a State focused on the institutionalization of rights and the applicability of justice for its demand and obligation at the time of its application.
